The charges against Monica Ussery for violating Governor Roy Cooper's stay-at-home order have been dropped. Ussery was arrested at the first Reopen NC rally on Apr. 14, 2020.
While Ussery had been convicted of the 2 misdemeanors at a bench trial (by a judge), she was awaiting a jury trial after exercising her right to appeal. [1]
Y'all might remember this incident from the infamous "Protesting is a non-essential activity" tweet from Raleigh Police when questioned on what part of the executive order Ussery had violated. [2]
Since I was parked two spots away from Ussery at that Reopen NC rally, I can confirm that she spent the rally social distanced at her vehicle.
The police testimony at the bench trial as to why/what she was doing when they arrested her didn't match with other witness testimony, and possibly the body cam video.
Ussery was denied access to the officers' body cam video captured at the scene before her first trial. The video was given to Ussery before her appeal trial, though the judge issued a gag order on its release.
Ussery is currently working to get that order removed and the video released.
